Sales Terms and Conditions
1. Parties
This "Sales Terms and Conditions" (hereinafter referred to as "Terms") is made between Yellowstone Software and IT Services Ltd. (hereinafter referred to as "Company" or "YSS") and the individual or entity purchasing services from the website (hereinafter referred to as "Customer").
2. General Provisions
2.1. The company, Yellowstone Software and IT Services Ltd. Co., provides IT services such as software, ERP, CRM, e-commerce websites, and domain sales.
2.2. The customer is deemed to have accepted the terms specified below by visiting this site and/or purchasing services from this site.
3. Services
3.1. The company provides the Customer with software (ERP, CRM, etc.), e-commerce site setup, domain purchase, and other IT services.
3.2. The scope of each service purchased is determined in accordance with the contract and proposal accepted by the parties. The customer declares that they are informed about the characteristics and scope of the service received.
4. Contract and Payment
4.1. The Customer enters into a contract with YSS by placing an order through the site. This contract becomes valid upon the Customer completing the payment process.
4.2. The customer shall pay the specified fees in advance in accordance with the payment methods (bank transfer, credit card, etc.).
4.3. Payments are mandatory for the validity of the order. Orders for which payment has not been made will not be processed.
5. Cancellation and Refund
5.1. The customer has the right to cancel the order before the delivery of the purchased product or service. However, for cancellations after delivery, returns or exchanges will not be made depending on the nature of the service provided by YSS.
5.2. In the case of digital products, software licenses, and similar services, returns or exchanges are not accepted from the moment the product is delivered.
6. Privacy and Data Protection
6.1. The Company will use the Customer's personal information solely for the purpose of providing the service and will not share it with third parties.
6.2. The Company takes all necessary measures to ensure the Customer's data security. However, the Company cannot be held responsible for damages arising from third-party attacks on the Customer's systems.
7. Intellectual Property Rights
7.1. The Customer acknowledges that all intellectual property rights to the software and services provided by the company belong to YSS.
7.2. The customer has the right to use YSS's software or services only in accordance with the license they have purchased.
8. Obligations and Responsibilities
8.1. The Company commits to providing the service requested by the Customer in the best possible way; however, the Company cannot be held responsible for interruptions in service due to force majeure events such as problems with the internet infrastructure or system failures.
8.2. The customer agrees to comply with the software's user manuals and all instructions provided by YSS.
9. Force Majeure
9.1. The company is not obligated to pay any compensation if it is unable to provide services due to force majeure events such as natural disasters, war, rebellion, strikes, epidemics, or government interventions.
10. Legal Disputes and Jurisdiction
10.1. İşbu sözleşmeden doğacak her türlü uyuşmazlık, İstanbul (Merkez) Mahkemeleri ve İcra Daireleri’nde çözülecektir.
10.2. The laws of the Republic of Turkey are applicable.
11. Changes
11.1. YSS reserves the right to make changes to these terms at any time. Changes will be effective as of the moment they are published on the website.
12. Implementation and Enforcement
12.1. These terms are effective from the date they are published on the website, and the Customer is deemed to have accepted these terms by purchasing the service.
